GZA's Chris Schmitt on New Discharge Prevention Containment & Countermeasure (DPCC) Plan Regulation

The New Jersey Department of Environmental Protection (NJDEP) has enacted new requirements for Discharge Prevention Containment and Countermeasure (DPCC) Plans, as discussed by Chris Schmitt in the latest issue of the New Jersey Association of Counties (NJAC) newsletter. Major Facilities, usually defined as facilities that store large quantities of hazardous and/or petroleum products, are now required to develop a Climate Resiliency Plan. 

The plan must address the facility’s ability to withstand climate related risks, including: 

  • Increased or extreme precipitation and related risks, such as flooding
  • Sea level rise
  • High winds and related storms
  • Extreme temperatures
  • Drought and related risks, such as wildfires

Currently, the new regulations only require that a Climate Resiliency Plan be created. The regulations do not specify or require that any actions be taken. However, it is recommended that Major Facility owners and municipal and county officials share knowledge of the completed Climate Resiliency Plans in order to better coordinate response in the face of sudden climate-related hazards.
